Many of us become an unpaid Carer during our lifetime and caring for a loved one can be hard. Some of our team at HR&OD have experienced being an unpaid Carer firsthand and understand the struggles you may be facing.

The Carer’s Leave Act 2023 set out that from the 6th of April 2024, those who are classed as employed can take time off to support a dependant who requires long-term care to help support their needs. This leave includes taking time off to arrange care packages to be put in place or to assist with the care of the person.

Dependants are individuals who have a physical or mental illness which requires them to receive care for more than 3 months, anyone with a disability as set out in the Equality Act 2010 and those needing care due to old age. They do not have to be a relative.

Carer’s leave can be taken from the first day of employment and any employment rights such as annual leave are protected until their return to work.

How much time can you take for carers leave?

An employee can take up to 1 week in 12 months for Carer leave, the 1 week is based on the employee’s contracted working week, therefore if you are contracted to work 4 days a week you can take 4 days off as Carer leave. It does not have to be a consecutive full week it can include half or full days. What are your pay entitlements?

Employers do not have to pay you for Carer leave, it is advised that you refer to your terms of employment or speak with your employer directly regarding questions around pay.

How much notice must you give?

Notice periods for this type of leave start at 3 days up to 12 days. You do not need to put the request in writing nor do you need to provide evidence of the dependent’s care needs. Employers can not refuse your leave however they can delay it if it causes serious interruptions to the business.
